Who We Are

Wicked Cool Toys, LLC (“Wicked Cool Toys”) was founded in 2012 to make playtime the most fun ever!   We are a dynamic top toy company located in the United States, with a focus on developing and delivering high quality innovative products and brands that kids love! 

Wicked Cool Toys is sensitive to privacy issues, and it is important to us to protect the information provided to us.  The Wicked Cool Toys Privacy Policy, which is incorporated by reference into Wicked Cool Toys’ Terms and Conditions, details the privacy practices of Wicked Cool Toys that apply to this Website. Wicked Cool Toys provides this privacy and information practices policy to inform you about our online information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can correct or update such information. 

“Personal Information” is any information relating to an identified or identifiable natural person (“Individual”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Under specific laws, personal information may include any information relating to a household.

Personal Information We Process

We collect Personal Information that (a) you actively submit to us, (b) is collected automatically through your interaction with the Website, and (c) is collected through your interaction with third-party services. 

  • (a) Actively Submitted Data.  We collect Personal Information from you such as email address, phone number or mailing address when you choose to request information about our products and services, register for a newsletter or loyalty program that we may offer from time to time, contact customer service or otherwise communicate with us. We also collect Personal Information from you when you choose to register an account with us. You have an option tocreate an account on Wickedcooltoys.com (the “Website”). As part of the registration process, you will be asked to complete a registration form and provide Personal Information such as first and last name, date of birth and email address, or you may be permitted to link your member account to your social media accounts. You will also be asked to choose a user ID and password in order to take advantage of certain features of the Website. Similarly, if you agree to provide us with optional profile information, this information will be collected through a registration form. 
  • (b) From time to time, we may ask you to participate in online polls or surveys. If you do decide to participate, you may be asked to provide certain information which may include Personal Information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our products, Website and/or services and in any manner consistent with the policies provided herein.
  • (c) Occasionally we will partner with Third Parties on social media and online channels to carry out contests and sweepstakes. Terms and conditions will accompany each contest and sweepstakes, and it is the responsibility of all entrants to read the terms and conditions and privacy policies carefully. If you choose to share your information in order to participate in a contest or sweepstakes, your entry information may be shared with such Third Parties.
  • (d) Information Collected Automatically.  We may collect certain information automatically when you interact with the Website, including your Internet Protocol (“IP”) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising identifiers, and other unique device identifiers. We may also collect pages that you visit before and after using the Website, the date and time of your visit, the amount of time you spend on each page, information about the links you click and pages you view within the Website, and other actions taken through use of the Website. We may use cookies, pixel tags, social media widgets, local storage, and other technologies to automatically collect information through the Website.

Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Website may not work properly.  A pixel tag (also known as a web beacon) is a piece of code embedded on the Website that collects information about users’ engagement on that web page. The use of a pixel allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement.

  • (e) Information collected through interaction with third-party services. Your personal information may be collected through your interaction with third-party services. For example, our Website may include social media features such as the Facebook “Like” button, and Twitter (that might include widgets such as the share this button or other interactive mini programs). These features may collect your IP address, which page you are visiting on our Website, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third-party or are hosted directly on our Website. The collection of your Personal Information by these third-party service providers is governed by the privacy policy of the company providing the service, which service is clearly indicated when using specific Website features. Please note we may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on our Website and to develop website content. We do not actively collect or otherwise process personal data from minors.  We do not actively collect or otherwise process special categories of personal data as identified in the EU General Data Protection Regulation (“GDPR”) including data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade-union membership, or genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. We do not actively collect or otherwise process personal data relating to criminal convictions and offences.

The personal data we process is generally in relation to our business-to-business activities and the provision of personal data is not a statutory requirement nor a contractual requirement on the part of the data subject, although we do provide services under our customer contracts. The possible consequences of failing to provide personal data is that we will be unable to respond to requests or inquiries or interact for business purposes.

(i) California Consumer Privacy Act.  Pursuant to the § 1798.110 of the California Consumer Privacy Act (“CCPA”) the categories of personal information we have collected about consumers in the preceding 12 months are:

  • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name;
  • Commercial information, including products or services purchased, obtained, or considered; other purchasing or consuming histories or tendencies;
  • Internet or other electronic network activity information, including, browsing history, search history, and information regarding a consumer’s interaction with an Internet Web site, or advertisement;
  • Geolocation data;
  • Professional or employment-related information; and
  • Inferences drawn from any of the information identified to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence abilities, and aptitudes.

Purposes for Processing Personal Information

We use your information for a variety of business purposes, including to:  

(a)To Provide Products, Services, or Information Requested. Wicked Cool Toysmay use information about you to fulfil requests for products, services, or information, including information about potential or future services, including to:

  • Manage Individual information accounts and business accounts;
  • Respond to questions, comments and requests;
  • Provide access to certain areas and features of the Wicked Cool Toys Website;
  • Allow you to register for events. 

(b) Operate our business pursuant to our legitimate interest.

(e) Use of De-identified and Aggregated Information. We may use Personal Information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our services, or other analyses we create.

(f) Research and Development. Wicked Cool Toys may use Personal Information alone or in the aggregate with information obtained from other sources, in order to help us to optimally deliver our existing products and services or develop new products and services.  From time to time, Wicked Cool Toys may perform research (online and offline) via surveys. We may engage Third-Party service providers to conduct such surveys on our behalf. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve Individuals by learning more about their needs and the quality of the products and services we provide. The survey responses may be utilized to determine the effectiveness of our services, various types of communications, advertising campaigns, and/or promotional activities. If an Individual participates in a survey, the information given will be used along with that of other study participants. We may share anonymous Individual and aggregate data for research and analysis purposes.

SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES

We may share your personal data in the following circumstances:

The types of service providers (processors) to whom we entrust Personal Information include: (i) IT and related services; (ii) information and services you have requested; (iii) payment processing; (iv) fulfilling orders for the products sold on this Website; (v) customer service providers; and (vi) vendors to support our Website and products sales.

(b) Business Partners. We may provide Personal Information to business partners with whom we jointly offer products or services.  In such cases, our business partner’s name will appear along with ours.  

(c) Affiliates. We may share Personal Information with our affiliated companies.

(d) Marketing Partners.  We may share personal information with third-party marketing or advertising partners for the purpose of delivering targeted advertisements to you, also referred to as “interest-based advertising.” You have an option to block targeted advertising through your browser settings and through Google. The online advertising industry also provides websites from which you may opt-out of receiving targeted ads from our data partners and our other advertising partners that participate in self-regulatory programs. (e) Disclosures to Protect Us or Others (e.g., As Required by Law and Similar Disclosures). We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect yours’, ours’ or others’ rights, property, or safety; (iv) to enforce Wicked Cool Toys policies or contracts; (v) to collect amounts owed to Wicked Cool Toys ; (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) if we, in good faith, believe that disclosure is otherwise necessary or advisable.

In addition, from time to time, server logs may be reviewed for security purposes, such as to detect unauthorized activity on the Website. In such cases, server log data containing IP addresses may be shared with law enforcement bodies in order that they may identify users in connection with their investigation of the unauthorized activities.

(f) Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. Should such an event occur, Wicked Cool Toys will endeavour to direct the transferee to use Personal Information in a manner that is consistent with the Privacy Policy in effect at the time such Personal Information was collected.

(g) Regulatory Bodies, Public Authorities and Law Enforcement. We may access and disclose your Personal Information to regulatory bodies if we have a good-faith belief that doing so is required under regulation.  This may include submitting Personal Information required by tax authorities. (i) Third-Party Sites and Social Media Platforms:  The Website may contain links to other websites and other websites may reference or link to our Website or other services. These other domains and websites are not controlled by us, and Wicked Cool Toys does not endorse or make any representations about Third-Party websites or social media platforms.  We encourage our users to read the privacy policies of each and every website and application that they interact with. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

All Personal Information sent or collected via or by Wicked Cool Toys may be stored anywhere in the world, including but not limited to, in the United States, in the cloud, our servers, the servers of our affiliates or the servers of our service providers.  Your Personal Information may be accessible to law enforcement or other authorities pursuant to a lawful request. In the event that Personal Information is transferred outside of the United States of America, we will ensure that adequate protections are implemented such as implementing Standard Data Protection Clauses.

In certain jurisdictions, individuals have rights in relations to Personal Information. For all individuals, where you are receiving communication from us of a marketing nature, we provide the ability for you to unsubscribe at the end of the email. You may also contact us directly to exercise your right to object to marketing communication or to exercise other rights. In addition, where Personal Information is collected for general business operations and that Personal Information is not required for regulatory or legal purposes or the like, we offer you a choice to limit the use and disclosure of your Personal Information. Individuals in the European Economic Area have certain rights which may be subject to limitations and/or restrictions. Storage of Personal Information

Personal Information is processed and stored at various locations including on servers located in the United States of America and throughout the world.

Data Retention

We retain the Personal Information we collect for a reasonable period of time to fulfil the processing purposes mentioned above. Personal Information is then archived for time periods required or necessitated by law or legal considerations. When archival is no longer required, Personal Information is deleted from our records. If you wish to request a deletion of your Personal Information, please contact us. Our contact details are provided at the end of this Privacy Policy. 

We retain Personal Information that we are required to retain in order to meet our regulatory obligations including tax records and transaction history.  We regularly review our retention policy to ensure compliance with our obligations under data protection laws and other regulatory requirements.  We regularly audit our databases and archived information to ensure that Personal Information is only stored and archived in alignment with our retention policy.

Security of Your Information

Wicked Cool Toys uses technical and organizational measures to protect the Personal Information that we store, transmit, or otherwise process against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access.  We regularly consider appropriate new security technology and methods as we maintain and develop our software and systems. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the Website or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Website. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Website or sending an e-mail to you. Depending on where you live, you may have a legal right to receive this notice in writing.
